Gospodarzem wydarzenia będzie University College Dublin – Sutherland School of Law we współpracy z UCD Centre for Constitutional Studies.

W ramach panelu „Reimagining Truth and Identity in EU Public Law through Courts, Markets and Interpretation” (1 lipca) będę miał przyjemność wygłosić referat pt. „Smart Courts and the Quest for Truth: Efficiency, Automation and Judicial Authority”

The digitalisation and computerisation of judicial proceedings in civil cases affect their timeliness and efficiency, enhancing access to courts and increasing procedural transparency. However, the use of new technologies in the everyday functioning of the judiciary may take on a dual character. On the one hand, it encompasses evolutionary solutions, such as replacing traditional service of documents with electronic service or paper case files with electronic files, primarily aimed at improving the management and organisation of judicial proceedings. On the other hand, these technologies may be employed in a revolutionary manner – not merely as tools supporting judges, but as elements that significantly interfere with the adjudicative process, including through the use of artificial intelligence tools. This gives rise to a fundamental question as to whether so-called smart courts can – and should – replace human judgment in the pursuit of truth and in delivering accurate judicial decisions. The paper seeks to present both perspectives and to highlight the tensions with which contemporary judicial systems must contend.
